1. Agreement to Terms
Welcome to Manstead. These Terms of Service (“Terms”) govern your access to and use of the Manstead mobile application and related services (collectively, the “Service”).
By accessing or using Manstead, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Important: These Terms contain a binding arbitration clause and class action waiver that affect your legal rights. Please read Section 15 carefully.
2. Eligibility
Age Requirement: You must be at least 18 years old to use Manstead. By using the Service, you represent and warrant that you are 18 years of age or older.
Legal Capacity: You must have the legal capacity to enter into a binding contract. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Geographic Restrictions: Manstead is available worldwide, but we may restrict access in certain jurisdictions where prohibited by law.
3. Account Registration and Security
Creating an Account: To access certain features, you must create an account by providing:
- A valid email address
- A username (which can be anonymous)
- A secure password
Account Security: You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
Account Accuracy: You agree to provide accurate, current, and complete information and to update it as necessary.
One Account Per Person: You may only create one account. Creating multiple accounts may result in suspension or termination.
4. Service Description
Manstead provides:
- A 90-day structured recovery program for pornography addiction
- 30 video lessons on recovery principles
- Daily check-ins and progress tracking
- Streak tracking and milestone badges
- A panic button feature with immediate support resources
- An anonymous community forum for peer support
- Exercise and reflection tools
- Push notifications for motivation and accountability
Not Medical Treatment: Manstead is a self-help educational program, not a medical treatment, therapy, or clinical service. We do not provide medical, psychiatric, or psychological services.
If you are experiencing a mental health crisis, suicidal thoughts, or severe psychological distress, contact emergency services immediately or call a crisis helpline.
No Guarantees: While we strive to provide helpful resources, we make no guarantees about recovery outcomes. Results vary by individual. Your success depends on your commitment and circumstances.
5. Subscription and Payment
Subscription Plans: Manstead offers paid subscription plans:
- Monthly subscription
- Annual subscription
- Promotional offers (subject to specific terms)
Pricing: Current pricing is displayed in the app before purchase. Prices are subject to change with notice.
Payment Processing: Payments are processed through:
- Apple App Store (for iOS)
- Google Play Store (for Android)
- Stripe (for web payments)
Payment terms are governed by the applicable platform’s terms of service.
Automatic Renewal: Subscriptions automatically renew unless you cancel before the renewal date. You will be charged the then-current subscription price.
Cancellation: You may cancel your subscription at any time through:
- iOS: Your Apple ID account settings
- Android: Your Google Play account settings
- Web: Your Manstead account settings
Cancellation takes effect at the end of the current billing period. You will retain access until that date.
No Refunds: All payments are non-refundable except:
- As required by law
- At our sole discretion
- Within our 30-day money-back guarantee period (see Section 6)
Free Trials: If we offer a free trial, you will be charged when the trial ends unless you cancel beforehand. Trial terms will be specified at sign-up.
6. 30-Day Money-Back Guarantee
We offer a 30-day money-back guarantee from your initial purchase date.
Eligibility:
- Available for first-time subscribers only
- Must be requested within 30 days of initial purchase
- Does not apply to renewal charges
- Limited to one refund per user
How to Request: Email hello@manstead.com with:
- Your account email address
- Reason for refund (optional but appreciated)
- Proof of purchase if requested
Processing:
- Refunds are processed within 7-14 business days
- Refunds are issued to your original payment method
- Your account will be deactivated upon refund
No Abuse: We reserve the right to deny refunds if we detect abuse, fraud, or violation of these Terms.
7. User Conduct
Prohibited Activities:
You agree NOT to:
General Prohibitions:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Impersonate any person or entity
- Harass, threaten, or harm others
- Upload viruses, malware, or malicious code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use automated systems (bots, scrapers) without permission
- Reverse engineer, decompile, or disassemble the app
Content Prohibitions:
- Post explicit sexual content, pornography, or triggering material
- Share personal information of yourself or others
- Post spam, advertisements, or promotional content
- Share copyrighted material without permission
- Post false, misleading, or fraudulent information
Community-Specific Prohibitions:
- Use profanity or abusive language
- Post links to external websites (for safety)
- Engage in bullying, discrimination, or hate speech
- Encourage self-harm, suicide, or dangerous behavior
- Solicit personal contact information from other users
Consequences: Violation of these rules may result in:
- Content removal
- Account suspension
- Permanent account termination
- Legal action if warranted
8. User Content
Content You Post: You may post content in the community, including text posts, comments, and reflections (“User Content”).
Ownership: You retain ownership of your User Content. However, by posting, you grant Manstead a worldwide, non-exclusive, royalty-free license to:
- Display, reproduce, and distribute your content within the Service
- Modify or adapt your content for technical purposes (e.g., formatting)
- Use anonymized or aggregated versions for marketing, research, or improvement
Content Standards: All User Content must comply with Section 7 (User Conduct) and our Community Guidelines.
No Obligation to Monitor: We are not obligated to monitor User Content but reserve the right to review, edit, or remove any content at our discretion.
Reporting: If you see content that violates these Terms, report it using the in-app reporting feature.
Backup Your Content: We are not responsible for loss of User Content. You should maintain your own backups.
9. Intellectual Property Rights
Manstead Ownership: All content, features, and functionality of the Service are owned by Manstead and protected by copyright, trademark, and other intellectual property laws.
This includes:
- Video lessons and course content
- App design, layout, and user interface
- Text, graphics, logos, and images
- Software, code, and algorithms
- Trademarks: “Manstead” and related marks
Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.
Restrictions: You may NOT:
- Copy, reproduce, or distribute our content
- Modify, create derivative works, or reverse engineer
- Remove copyright or proprietary notices
- Use our trademarks without written permission
- Frame or mirror any part of the Service
- Sell, license, or exploit the Service commercially
Third-Party Content: Some content may be provided by third parties. That content is the property of its respective owners.
Feedback: If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation or compensation to you.
10. Third-Party Services and Links
External Links: The Service may contain links to third-party websites or resources (e.g., support groups, Covenant Eyes, research articles).
No Endorsement: These links are provided for convenience. We do not endorse or control third-party sites and are not responsible for their content, privacy practices, or terms.
Use at Your Own Risk: Your use of third-party services is at your own risk and subject to their terms and policies.
Accountability Software: If you choose to use accountability software (e.g., Covenant Eyes) through our recommendations:
- That software operates independently
- It is governed by the provider’s terms and privacy policy
- We are not responsible for its functionality or data practices
- You enter into a separate agreement with that provider
11. Disclaimer of Warranties
AS-IS BASIS:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
NO WARRANTIES:
TO THE FULLEST EXTENT PERMITTED BY LAW, MANSTEAD DISCLAIMS ALL WARRANTIES, INCLUDING:
- Fitness for Purpose: We do not warrant that the Service will meet your needs or help you overcome addiction
- Accuracy: We do not warrant that content is accurate, complete, or current
- Availability: We do not warrant uninterrupted or error-free access
- Security: We do not warrant that the Service is free from viruses or malicious code
- Results: We do not guarantee any specific outcomes from using the program
No Medical Advice: The Service provides educational information only, not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns.
User Responsibility: Your use of the Service is at your own risk. You are solely responsible for your recovery decisions and actions.
12. Limitation of Liability
MAXIMUM LIABILITY:
TO THE FULLEST EXTENT PERMITTED BY LAW, MANSTEAD’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR £100, WHICHEVER IS GREATER.
EXCLUDED DAMAGES:
MANSTEAD SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Personal injury or emotional distress
- Relapse or failure to achieve recovery
- Unauthorized access to your account
- Errors, interruptions, or delays in the Service
- Third-party content or services
- Any damages beyond our reasonable control
Basis of the Bargain: These limitations apply even if Manstead has been advised of the possibility of such damages. These limitations are fundamental to our agreement and reflect the fees charged.
Jurisdictional Variations: Some jurisdictions do not allow certain limitations on liability. In such cases, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Manstead, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Your violation of any third-party rights
- Your violation of applicable laws
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense.
14. Termination
By You: You may delete your account at any time through the app settings. Deletion is permanent after 30 days.
By Us: We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- You abuse or harass other users
- We are required to do so by law
- We discontinue the Service
Effect of Termination: Upon termination:
- Your right to use the Service ends immediately
- Your User Content may be deleted
- Subscription fees are non-refundable (except as stated in Section 6)
- Sections that should survive (e.g., disclaimers, limitations) remain in effect
Survival: The following sections survive termination: 8 (User Content – license), 9 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 15 (Dispute Resolution), and 16 (General Provisions).
15. Dispute Resolution and Arbitration
READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Governing Law: These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Informal Resolution: Before filing any claim, you agree to contact us at hello@manstead.com to attempt to resolve the dispute informally. We will do the same if we have a dispute with you.
Provide:
- Your name and contact information
- Description of the dispute
- Your proposed resolution
We will attempt to resolve disputes within 60 days.
Binding Arbitration: If informal resolution fails, you agree that disputes will be resolved through binding arbitration, not in court, except as stated below.
Arbitration Rules:
- Arbitration will be conducted under the rules of a recognized arbitration body (e.g., the Chartered Institute of Arbitrators)
- The arbitrator’s decision is final and binding
- Arbitration will be conducted in English
- Location will be determined by the arbitration body
Exceptions to Arbitration: The following may be brought in small claims court or court:
- Claims within small claims court jurisdiction
- Injunctive relief to protect intellectual property
- Claims brought by government authorities
Class Action Waiver: YOU AGREE TO BRING CLAIMS INDIVIDUALLY, NOT AS PART OF A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
You waive any right to:
- Participate in a class action lawsuit
- Act as a class representative
- Combine your claim with other users’ claims
Opt-Out: You may opt out of arbitration within 30 days of accepting these Terms by emailing hello@manstead.com with “Arbitration Opt-Out” in the subject line and your name and email address. This does not affect any other Terms.
Severability: If any part of this arbitration clause is found invalid, the remainder remains in effect, except that if the class action waiver is invalid, the arbitration clause is void.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Manstead regarding the Service.
Changes to Terms: We may update these Terms at any time. Changes will be posted in the app with an updated “Last Updated” date.
- Material changes will be notified via email or in-app notification
- Continued use after changes constitutes acceptance
- If you don’t agree to changes, you must stop using the Service and delete your account
Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
Assignment: You may not assign or transfer these Terms. We may assign them without restriction.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, wars, internet failures, pandemics).
No Third-Party Beneficiaries: These Terms do not create rights for any third parties.
